Welcome to Velixar. These Terms of Service ("Terms") govern your access to and use of the Velixar website (velixar.org), our payment solutions, APIs, SDKs, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Description of Services

Velixar provides B2B payment processing solutions, API/SDK integration modules, real-time analytics dashboards, fraud prevention tools, and cross-border payment infrastructure (the "Services"). Velixar acts as a technology provider facilitating payment integrations and does not act as a bank, financial institution, or custodian of user funds unless explicitly stated in a separate Master Service Agreement (MSA).

2. Account Registration and Partner Onboarding

2.1. Eligibility: To use our Services, you must be a registered business entity and strictly comply with our onboarding and compliance procedures (KYB/KYC).

2.2. Accuracy of Information: You agree to provide accurate, current, and complete information during the application and onboarding process and to update such information to keep it accurate.

2.3. Account Security: You are entirely responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens.

4.1. PCI DSS Compliance: As a merchant or partner, you represent and warrant that you comply with all applicable Payment Card Industry Data Security Standards (PCI DSS).

4.2. Fraud Prevention: While Velixar implements advanced fraud prevention measures, you acknowledge that no system is entirely foolproof. You are ultimately responsible for chargebacks, refunds, and fraudulent transactions processed through your platform.

5. Intellectual Property

All rights, title, and interest in and to the Services, including our RESTful APIs, SDKs, dashboards, documentation, and all associated intellectual property rights, are the exclusive property of Velixar (or our licensors). We grant you a limited, non-exclusive, non-transferable, and revocable license to use our APIs/SDKs solely for integrating your platform with our Services.

6. Fees and Payments

The fees for using our Services (e.g., integration costs, transaction fees, cross-border conversion rates) will be outlined in a separate Master Service Agreement (MSA) or pricing schedule provided directly to your business during the onboarding process.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VELIXAR, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (iii) CHARGEBACKS, PAYMENT DELAYS, OR FAILURES CAUSED BY THIRD-PARTY WALLETS (E.G., JAZZCASH, EASYPAISA) OR BANKING NETWORKS.

8. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Velixar makes no warranties, expressed or implied, regarding the continuous availability of the Services or that the integration will be error-free.

9. Suspension and Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms or fail to comply with AML/KYC regulations.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
